Overview

trainingbites.net (the "Site") is operated by Sniff & Shift LLC. Throughout these terms, "we", "us" and "our" mean Sniff & Shift LLC. We offer this Site, including all information, tools and services on it (the "Service"), on the condition that you accept these Terms of Service ("Terms") and the policies and notices they refer to.

By visiting the Site or buying something through it, you agree to these Terms, including the additional terms and policies linked here. They apply to everyone who uses the Site, including visitors, customers and anyone who contributes content. If you do not agree to all of these Terms, please do not use the Site. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

Orders are placed on sniffandshift.com. This Site does not take payment. When you select Checkout, your cart is sent to Sniff and Shift's Shopify store at sniffandshift.com, and your order, payment, account and delivery are governed by the store's Terms of Service together with its Refund Policy, Shipping Policy, Subscription, Pre-Order, and Try Before You Buy Policy, Privacy Policy and Raw Product, Feeding, and Assumption of Risk Notice. Summaries for this Site are at Shipping, Refunds, Cancellations, Privacy and Legal Notice. If a summary here differs from a store policy, the store policy controls.

New features or tools added to the Site are also subject to these Terms. You can read the current version on this page at any time. We may update, change or replace any part of these Terms by posting changes here. Please check this page from time to time. Your continued use of the Site after changes are posted means you accept them.

The store is hosted on Shopify Inc., which provides the ecommerce platform we use to sell our products. This Site is hosted on Cloudflare.

Section 1. Using the Site

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province, or that you are the age of majority and have given us consent to allow your minor dependents to use the Site. You may not use our products for any illegal or unauthorized purpose, and you may not, in using the Service, violate any laws in your jurisdiction (including copyright laws). You must not transmit worms, viruses or any destructive code. A breach of any of these Terms will result in immediate termination of your use of the Service.

Section 2. General conditions

We may refuse Service to anyone for any reason at any time. Your content (not including card information) may be transferred unencrypted over various networks and changed to meet the technical requirements of connecting networks or devices. Card information is always encrypted in transfer and is entered only on Shopify's checkout, never on this Site. You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, its use, or access to it without our express written permission. Headings are for convenience only and do not limit these Terms.

Section 3. Accuracy and timeliness of information

We are not responsible if information on this Site is not accurate, complete or current. The material on this Site, including treat guides and feeding information, is provided for general information only and should not be relied on as the only basis for decisions without consulting primary, more accurate, more complete or more timely sources. Any reliance on it is at your own risk. See the Pet Care Disclaimer. The Site may contain historical information, which is not current and is provided for reference only. We may change the Site's content at any time but have no obligation to update it. It is your responsibility to watch for changes.

Section 4. Changes to the Service and prices

Prices are subject to change without notice. Prices shown on this Site are read from the store and may lag behind it; the price shown at checkout on sniffandshift.com is the price you pay. We may change or discontinue the Service, or any part of it, at any time without notice. We are not liable to you or any third party for any change, price change, suspension or discontinuance of the Service.

Section 5. Products

Some products may be available only online and in limited quantities. Returns and exchanges are governed only by our Refund Policy. Cancellations are covered by the Cancellation Policy, and any recurring order, pre-order or Try Before You Buy offer placed on sniffandshift.com is also governed by the store's Subscription, Pre-Order, and Try Before You Buy Policy. All orders are subject to the Shipping Policy, and all products are subject to the Raw Product, Feeding, and Assumption of Risk Notice in our Legal Notice. Each of these is incorporated into these Terms by reference.

We try to show product colors and images as accurately as possible, but we cannot guarantee that your screen shows any color accurately. We may limit sales of products to any person, region or jurisdiction, case by case, and may limit quantities. Product descriptions and prices may change at any time at our sole discretion. We may discontinue any product at any time. Any offer made on this Site is void where prohibited. We do not warrant that the quality of any product, service, information or other material you buy or obtain will meet your expectations, or that errors in the Service will be corrected.

Section 6. Billing and account information

We may refuse any order. We may, at our sole discretion, limit or cancel quantities bought per person, per household or per order, including orders placed by or under the same customer account, the same card, or the same billing or shipping address. If we change or cancel an order, we may try to tell you using the email, billing address or phone number given with the order. We may limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to give current, complete and accurate purchase and account information for every purchase, and to update your account promptly, including your email address and card details, so we can complete your transactions and contact you. Accounts are held on sniffandshift.com.

Section 7. Optional tools

We may give you access to third-party tools that we do not monitor, control or have input into. You agree that we provide such tools "as is" and "as available", without warranties, representations, conditions or endorsement of any kind, and that we have no liability arising from your use of them. Your use of optional tools is at your own risk, and you should make sure you understand and accept the provider's terms. New services or features we offer through the Site are also subject to these Terms.

Some content, products and services on the Site may include material from third parties. Links to third-party sites may take you to sites not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we do not warrant and are not liable for any third-party material, website, product or service. We are not liable for any harm or damages related to goods, services, resources, content or transactions on third-party sites. Please review a third party's policies before you engage with it, and direct complaints or questions about third-party products to that third party. Section 9. Comments, feedback and submissions

If you send us submissions at our request (for example contest entries), or send creative ideas, suggestions, proposals, plans or other material without our request, by email, post or otherwise ("comments"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use them in any medium. We have no obligation to keep comments confidential, to pay for them, or to respond to them.

We may, but do not have to, monitor, edit or remove content we decide in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable, or that violates anyone's intellectual property or these Terms. You agree that your comments will not violate any third party's rights, including copyright, trademark, privacy and personality rights, and will not contain libelous or otherwise unlawful, abusive or obscene material or any virus or malware. You may not use a false email address, pretend to be someone else, or otherwise mislead us or others about the origin of a comment. You are solely responsible for your comments and their accuracy. We take no responsibility and assume no liability for comments posted by you or any third party.

Product reviews shown on this Site are collected by Judge.me on sniffandshift.com and are subject to the store's terms.

Section 10. Personal information

Information you submit through the Site is governed by our Privacy Policy. Information you submit at checkout or in your account is governed by the store Privacy Policy.

Section 11. Errors, inaccuracies and omissions

The Site may occasionally contain typographical errors, inaccuracies or omissions about product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We may correct any of them, and change or update information or cancel orders if information on the Site or a related website is inaccurate, at any time without prior notice, including after you have submitted your order. We have no obligation to update, amend or clarify information on the Site or any related website, including pricing, except as required by law. No update or refresh date on the Site means that all information has been updated.

We do not guarantee, represent or warrant that your use of the Service will be uninterrupted, timely, secure or error free, or that results obtained from it will be accurate or reliable. You agree that we may remove the Service for indefinite periods or cancel it at any time without notice.

In no case shall Sniff & Shift LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs or similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Service or any product obtained through it, or any other claim related in any way to your use of the Service or any product, including errors or omissions in any content, or any loss or damage of any kind resulting from the use of the Service or any content (or product) posted, transmitted or otherwise made available through it, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in those places our liability is limited to the maximum extent permitted by law.

Section 14. Indemnification

You agree to indemnify, defend and hold harmless Sniff & Shift LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising from your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Section 15. Severability

If any provision of these Terms is found unlawful, void or unenforceable, it will still be enforced to the fullest extent permitted by applicable law, and the unenforceable part will be treated as severed from these Terms. That will not affect the validity and enforceability of the remaining provisions.

Section 16. Termination

Obligations and liabilities incurred before termination survive it. These Terms are effective until terminated by you or us. You may end them at any time by telling us you no longer wish to use the Service, or by ceasing to use the Site. If, in our sole judgment, you fail or we suspect you have failed to comply with any of these Terms, we may also end this agreement at any time without notice, you remain liable for all amounts due up to and including the date of termination, and we may deny you access to the Service or any part of it.

Section 17. Entire agreement

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it. These Terms and any policies or operating rules we post on the Site or about the Service make up the entire agreement between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, oral or written, including prior versions of these Terms. Any ambiguity in interpreting these Terms will not be construed against the drafting party.

These Terms and any separate agreements under which we provide you services are governed by and construed under the laws of the Commonwealth of Pennsylvania and the applicable federal laws of the United States, without regard to conflict of law principles.

It is your responsibility to check for changes. Your continued use of or access to the Site after changes are posted means you accept them.
